These Terms of Use ("Terms") govern your access to and use of Tomson Studio (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least the age of majority in your jurisdiction to use the Service. You are responsible for the information you provide, for maintaining the confidentiality of your credentials, and for all activity that occurs under your account.
2. The Service
Tomson Studio is subscription software for planning and producing short films. The Service provides project organization, script editing, character and location libraries, scene workflow, stitching and export. It integrates with third-party providers that you connect using your own API keys. Tomson Studio does not sell, bundle or resell AI generation credits or provider usage.
3. Subscriptions and billing
Paid plans charge a recurring fee for access to Tomson Studio software features (such as higher project and scene limits). Subscription fees do not include charges from third-party providers. You are solely responsible for any costs incurred with your own provider accounts and API keys.
Our order process is conducted by our online reseller Lemon Squeezy, acting as Merchant of Record for all orders. Lemon Squeezy processes your payment, collects and remits applicable sales tax and VAT, and handles order-related inquiries, refunds and chargebacks. Your purchase is also subject to Lemon Squeezy's terms and privacy policy. Subscription charges will appear on your statement under Lemon Squeezy. You can cancel your subscription at any time; access continues until the end of the current billing period. Refunds are handled as described in our Refund Policy.
4. Your content
You retain ownership of the prompts, references and other materials you upload ("Your Content"), and of the outputs you generate, to the extent permitted by applicable law and the terms of the underlying AI providers. You grant us a limited license to store and process Your Content solely to operate and improve the Service.
5. Acceptable use
You agree not to use the Service to:
- create content that is unlawful, infringing, defamatory, or violates the rights of others;
- generate sexual content involving minors, or non-consensual or deceptive likenesses of real people;
- produce content intended to harass, defraud, or mislead;
- impersonate any person or entity, or create deceptive "deepfake" content depicting real people without their consent;
- promote violence, hatred, or discrimination against individuals or groups;
- circumvent usage policies or safety systems of the Service or of connected third-party providers;
- attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.
You are responsible for the content you create with the Service, and your use of connected providers must also comply with each provider's own acceptable-use and safety policies. We may remove content and suspend or terminate accounts that violate this section. To report abusive content, contact us at [email protected].
6. Third-party providers
When you use connected providers, outputs are produced by third-party services and may be inaccurate or unexpected. You are responsible for reviewing outputs before use, for complying with each provider's terms, and for any costs billed by those providers.
7. Intellectual property
The Service, including its software, design and branding, is owned by Tomson Studio and protected by intellectual property laws. These Terms do not grant you any rights in our trademarks.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
9. Limitation of liability
To the maximum extent permitted by law, Tomson Studio will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, revenue or profits, arising from your use of the Service.
10. Termination
We may suspend or terminate your access if you violate these Terms. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.
